Terms of Use

Please read these Terms of Use ("Terms") carefully before using the PrimeBite Fishing mobile application ("App") operated by PrimeBite LLC, an Illinois limited liability company ("PrimeBite," "we," "us," or "our").

Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

The App provides solunar bite time predictions, weather- and ocean-supported fishing forecasts, fishing logbook features, subscription features, optional private account sign-in, and related fishing information. The App is designed to keep Logbook data local-first on your device, while some forecast, subscription, and optional account features rely on third-party services.

Natural-bait guidance is general fishing information, not legal advice. You must check and follow all state and local bait, possession, transport, and disposal rules.

Tide Predictions and Worldwide Tide Service

PrimeBite may show NOAA tide predictions when a clear nearby NOAA station exists. If NOAA has no clear match, you may choose to request worldwide tide predictions through WorldTides. Tide predictions are estimates, not observed water levels, and are not for navigation, emergencies, safety decisions, or determining the App's fishing rating. Worldwide tide requests may be limited, unavailable, or stop when the provider credit balance is used.

Optional Accounts

PrimeBite may offer optional account sign-in through Sign in with Apple, Sign in with Google, or email magic links. Account sign-in is optional. Signing in does not by itself move your old Logbook trips, catches, or photos off your device. If PrimeBite later offers a Logbook copy or migration flow, that will be a separate step you must review and confirm. If you later use Delete Account inside the app, PrimeBite removes the optional Supabase account/profile and any account-side copied Logbook data tied to it, while leaving the local Logbook already on your phone unless you delete that local data separately.

Account Controls

If you use an optional account, you can sign out or delete that account inside the app. Signing out disconnects the account but does not delete the local Logbook stored on your phone. Deleting the optional account removes the Supabase account/profile and any account-side copied Logbook data tied to it, while leaving the local Logbook already on your phone unless you delete that local data separately. Deleting your account does not cancel an Apple App Store or Google Play subscription; cancel billing separately through the store. If you used Sign in with Apple, also go to iPhone Settings > your name > Sign in with Apple > PrimeBite > Delete > Stop Using to fully revoke Apple's sign-in access. See the Privacy Policy for how to request review or deletion of remaining PrimeBite-controlled records.

Optional Research Use of Logbook Data

If you enable "Help improve ratings" in Settings, you save an optional preference. In the current release, this switch does not upload your Logbook because the cloud-upload gate is closed. The choice stays on your phone and, when you are signed in, its value, consent version, and change time may also be saved to your Supabase profile. The preference is separate from account sign-in and can be changed any time in Settings.

Subscription Services

PrimeBite Pro Subscription: The App offers a premium subscription service ("PrimeBite Pro") that provides access to extended forecast features, including:

  • 30-day bite forecast
  • Best window predictions
  • Weather-integrated ratings
  • Customizable forecast notifications

We may also grant promotional, complimentary, trial, partner, or creator access to PrimeBite Pro at our discretion. Eligibility, duration, feature scope, and renewal terms for that access may differ from standard paid subscriptions.

Subscription Terms

  • Free Trial: Eligible new subscribers may receive a 14-day free trial. The App Store or Google Play purchase screen shows whether you are eligible before you confirm.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Billing: Paid subscriptions are billed monthly or yearly, depending on the plan you select. Payment will be charged to your Apple ID or Google account at confirmation of purchase.
  • Cancellation: You can cancel your subscription at any time through your device's App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period.
  • Refunds: Refund requests are handled by Apple or Google according to their respective policies. We do not process refunds directly.
  • Price Changes: We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to subsequent billing periods.
  • Promotional or Complimentary Access: We may issue free or discounted access, including creator or partner access, and may modify or revoke that access according to the terms of the applicable offer and these Terms.

User Responsibilities

  • If you choose to use an account, you are responsible for maintaining access to your sign-in method and device.
  • You agree to use the App only for lawful purposes and in accordance with these Terms.
  • You will not attempt to reverse engineer, modify, or create derivative works of the App.
  • You will not use the App to violate any applicable laws or regulations.

Intellectual Property

The App and its original content, features, and functionality are owned by PrimeBite LLC and are protected by applicable intellectual property laws.

Your Content

You keep ownership of Logbook entries, photos, feedback, and other content you create. Content stored only on your phone is not licensed to PrimeBite. When you clearly choose to send feedback or a feedback photo, you give PrimeBite a limited, non-exclusive license to store, copy, review, and process that content only as needed to provide support, protect the service, and improve the App. If a future Logbook copy or research flow is offered, its exact use and choices must be shown before you confirm it.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The App will be available at all times or free from errors
  • Bite time predictions will result in successful fishing
  • The App will meet your specific requirements

Fishing success depends on many factors beyond our control, including weather, location, skill, and luck. Bite time predictions are estimates based on solunar data and should be used as a guide, not a guarantee.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Changes to Terms

We may update these Terms. We will update the date above and provide any other notice required by law for a material change. Changes do not remove rights you already have under applicable law.

Termination

We may suspend or end account access when reasonably needed for a serious breach of these Terms, fraud, abuse, security, legal compliance, or ending the service. Store subscription and refund rights remain subject to Apple or Google rules and applicable law.

Governing Law

These Terms are governed by Illinois law, without regard to conflict-of-law rules. Any dispute that must be filed in court will be handled in the state or federal courts serving Cook County, Illinois, unless the consumer laws where you live require another forum or give you rights that cannot be waived.

Apple App Store Terms

If you downloaded the App from the Apple App Store, Apple's also applies. These Terms add to that agreement and control only where they do not conflict with Apple's required terms. You acknowledge that:

  • These Terms are between you and us, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support for the App
  • In the event of any failure of the App, you may notify Apple, and Apple will refund the purchase price (if applicable)

Google Play Store Terms

If you downloaded the App from Google Play Store, you acknowledge that:

  • These Terms are between you and us, not Google
  • Google is not responsible for the App or its content
  • Google has no obligation to provide support for the App
